Absolute Liability
Absolute liability is responsibility without fault or negligence. Absolute liability crimes are those that can be punished without a finding of mens rea (state of mind/criminal intent). For example, most public welfare offenses (regulatory crimes) are absolute liability crimes (e.g. traffic violations, food safety violations). Absolute liability and “strict liability” are sometimes used interchangeably.
